Terms of Service

These Terms govern your use of Flowhush (the "Service"), operated by FOP Vakhula Bohdan Yaroslavovych (ФОП Вахула Богдан Ярославович), a sole proprietor (individual entrepreneur) located in Dubliany, Lviv Oblast, Ukraine ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

Flowhush provides heartbeat monitoring: you create monitors, your systems send HTTP requests ("pings") to unique URLs, and we notify you when expected pings do not arrive or when submitted output fails rules you configure.

2. Accounts

You sign in with a link sent to your email address. You are responsible for keeping access to that mailbox secure and for all activity under your account. You must be at least 18 years old or the age of majority where you live.

3. Acceptable use

You may not use the Service to send unlawful content, personal data you are not permitted to share, malware, or traffic intended to disrupt the Service; to probe or bypass our security; or to resell the Service without permission. Do not send secrets, passwords or special-category personal data in ping bodies.

4. Plans, billing and taxes

Paid plans are billed in advance monthly or yearly. Our order process is conducted by our online reseller Creem (creem.io). Creem is the merchant of record for all our orders: it sells the subscription to you, processes the payment, calculates and collects applicable sales tax/VAT, and issues invoices and receipts. Creem's own terms of sale apply to the payment. Prices may change with at least 30 days' notice; changes apply from your next billing period.

5. Cancellation

You can cancel at any time from the billing page or Creem's customer portal. Your paid features remain until the end of the current billing period. Refunds are handled according to our Refund Policy.

6. Availability and no guarantee

We work to keep the Service reliable, but it is provided "as is" and "as available". Monitoring and alert delivery can be delayed or fail (for example due to email, chat-platform or network outages). The Service is a supplementary tool and must not be your only safeguard for critical systems.

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, lost profits or lost data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

8. Suspension and termination

We may suspend accounts that violate these Terms or put the Service at risk. You may delete your account at any time by contacting support@flowhush.com.

9. Changes

We may update these Terms; material changes will be announced by email or in the dashboard. Continued use after changes take effect means you accept them.

10. Governing law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. Disputes will be resolved by the competent courts of Ukraine. This does not limit any mandatory consumer protections you have under the law of your country of residence.
